This is a legal agreement ("Agreement") between the visitor/member and Ushodaya Enterprises Private Limited, hereinafter referred to as UEPL, the owner and operator of the website/portal
and such other web site that may be periodically linked either to this web address or to the home page of Eenadu online news edition, hereinafter referred jointly and severally as the portal / app.
Access to the portal / app cannot be had unless and until these terms and conditions are read and consented to.
Membership :
A. By registering a profile, one becomes a member of www.eenadupellipandiri.net.
B. The consent to process digital personal data shall be given only by the person whose digital personal data is required to be processed. No proxy is allowed in this regard. If the parents of the member intend to operate the account on behalf the member, they may do so, only after providing the written consent of the member for processing the digital personal data.
C. Members who remit the prescribed fees to avail the benefits of any special services under any of the scheme, becomes a paid member, as soon as the fees is duly accepted by UEPL and as soon the paid membership is activated. A consent letter from the concerned bride/groom may be required by UEPL to access your personal identifiable data and to process it for providing the required services.
Such members or their family members may contact customer service executive at +91 8008001686 where staff of "eenadupellipandiri.net" would assist the members in selecting and accessing contact information of the interested profiles, subject to the limitations of the package
D. The membership to the portal / app is only for the sole, exclusive, personal use of the member. The membership is non-transferable.
E. A member cannot authorize others to use his/her membership. A member cannot re-distribute the information on the portal / app, available to anyone else either gratuitously or for any consideration. Any such action will lead to cancellation of membership and legal action.
F. The Membership of eenadupellipandiri.net is not transferable and not assignable to any third party. It cannot be assigned, transferred or licensed or used by any person/entity other than a registered member.
G. Commercial use of information is strictly prohibited. Any entity found indulging in misuse of membership shall be prosecuted.
H. The individuals seeking membership may, at the discretion of UEPL be asked to furnish proof of their age, residence, nationality, academic qualifications, other credentials claimed and such other information, before granting access to the portal / app or membership.
I. Such information will be verified through approved identity cards or facility like digilocker. The membership is always subject to verification of identity. UEPL has the right to do a reference check in order to establish the credentials of the member before activating the profile on the website.A right to undertake such reference check is inherent and can be made at any time during the active status of the user account. UEPL shall not furnish any material or information displayed on the portal / app to anyone.
J. UEPL accepts certain information like sexual orientation, academic and career related information in good faith. UEPL docs not vouch the correctness of such information and shall not liable for any errors in such information provided on EPP Portal.
K. The Member brides /Member grooms or their parents shall not charge any expenses for sharing any information. UEPL does not encourage any charges/expenses being collected. Members are advised to exercise caution while dealing with Members/ parents of members/ marriage bureaus or intermediaries, and UEPL shall not be responsible or liable for any such demands/ payments.
Members registering on "Eenadupellipandiri.net" shall be automatically consenting for receiving calls and Text Messages from eenadupellipandiri.net. by any mode, including whatsapp.
A. A profile of a member is created by filling up the application online.
B. Member may upload his/her photograph or a video clipping, subject to technical feasibility.
A. Only owners of photos, data, profiles or any other material can upload the same to the site. Others cannot upload or submit material for display on the portal / app. No material that does not belong to the member shall be, uploaded only latest photos must be uploaded. However, UEPL shall not be responsible or liable for any mismatch between the photo and the person.
B. The person uploading/submitting material to the portal / app is presumed in good faith to be the owner of such material and that such owner has placed/uploaded/submitted/made available under an assurance and undertaking and warranty that he/she is the owner of the material placed/ uploaded/ submitted/made available and with a further irrevocable right/authorization in favour of UEPL to display the material on the portal / app without any obligation whatsoever on the part of UEPL or on such other persons authorised by UEPL either expressly or impliedly, to pay any remuneration, royalty, license fee etc. and such right/ authorization shall be without any territorial and time restrictions.
C. UEPL reserves the right to reject/edit/delete any photo/video/horoscope if in the opinion of UEPL, it is not a valid/clear/related one.
D. UEPL reserves the right to modify or reject the profile of any member, if any prohibitive or objectionable content is found, or if contact details of any member are entered in unrelated fields. UEPL may also modify or reject the profile for other reasons not mentioned herein, in which event, the prospective member or member shall only be entitled to refund of subscription/membership paid if any, and UEPL shall be under no other contractual or legal obligation with such prospective member or member.
E. The person uploading profile and material on website shall be personally responsible and liable to any third party whose rights are impinged upon by any material uploaded and shall also be liable for any damage or loss caused to UEPL and by such person shall indemnify UEPL as well as the third party against any claim in respect to the material uploaded on the site.
F. If duplicate profiles are found, UEPL has right to suspend any or all of the profiles.
G. The members shall not post any defamatory, offensive, excessive, exaggerated, false, malafide, inaccurate, erroneous, blasphemous, obscene, profane, pirated, offensive, salacious, ghastly, indecent, racial or illegal material on the portal /app.
H. The members shall not charge fees for sharing any of their information. UEPL shall not be responsible or liable for any monetary transactions between any two sets of members or visitors.
I. No advertisement can be made on the portal / app of any product or service or no offer of any sale of goods or services can be made without the prior consent of UEPL.
J. No mails can be sent through the portal / app and any transaction other than the permitted transaction is strictly prohibited.
K. The members shall not submit or upload any material, which impinges upon or infringes the intellectual property rights of third parties. There shall be an implied assurance and undertaking from the members about the ownership, genuineness veracity and originality of all the information, photographs profiles or other material submitted and uploaded on the site.
A. Profile of a free member will be automatically deleted if it is not active for 6 months.
B. UEPL has the right to suspend or deactivate or delete the profile of any member without any prior notice. In the event of such suspension/deactivation, the Members shall not be entitled for any compensation from Ushodaya Enterprises Private Limited.
6. CANCELLATION OF MEMBERSHIP:
A. UEPL reserves unfettered right to cancel any membership at any stage, without assigning any reason whatsoever. The member who thus forfeits the membership shall not have any claim whatsoever refund of fee calculated pro-rata for unexpired term of membership and deletion/erasure of any material given or any information furnished to UEPL.
B. A membership will automatically be cancelled if any abusive, obscene or sexually oriented message/s or photo/s or video/s is sent by any member to other members or if such material is added to any profile or in case of any misbehaviour or objectionable conduct by a member. Such Members shall not be entitled for refund of membership fee or for any compensation from Ushodaya Enterprises Private Limited.
7. TERMINATION OF AGREEMENT:
This agreement can be terminated by either of the parties at any time, for any reason without notice to the other party. This right is without prejudice to the right of UEPL to suspend or terminate the access of the member to the portal / app without notice for any breach of this Agreement.
8. SCHEMES:
UEPL offers periodically, different types of schemes on the site, for the convenience of all the members, each with their own distinct benefits. UEPL reserves the right to modify, amend, alter, change or discontinue the schemes at their absolute discretion. Members are advised to refer membership plans for current schemes.
9. ONLINE CHAT:
UEPL provides special services like ‘online chatting’, etc to paid members. The ‘online chat’ feature is primarily provided to facilitate online contact of two members. UEPL does not record or otherwise store any data transferred during ‘online chatting’ by members. Members shall not approach UEPL for copies/transcript of such chat.
10. Ownership:
Eenadupellipandiri portal/ app is owned and operated by Ushodaya Enterprises Private Limited a Company in Ramoji Group. The Company hereby reserves the right to change or discontinue any service, feature, offer, gift, contest, design, layout, content, platform, equipment, systems, programme, software needed for the access or use of the portal/ app including member's area.
A. The members shall furnish truthful, authentic, genuine, relevant, valid, correct, current, fair information for being displayed or posted on the site.
B. The members shall provide proof as may be required by UEPL to substantiate the information furnished. The members shall provide consent in writing for processing and storage of their digital personal data.
C. Every member impliedly undertakes personal responsibility and liability as to the correctness, veracity authenticity, genuineness of the information furnished for display on site.
D. The onus of proving the correctness of information furnished and displayed on the portal/ app lies on the concerned members. UEPL does not undertake any background verification of members or of any information furnished by the members.
E. The onus of proving that the information is wrong lies on the members/third parties asserting, relying on/using the information.
F. It shall be the duty of the visitors and members seeking alliance from the members whose profiles are displayed on portal/ app to cause thorough enquiry and cross-check the correctness, authenticity, currency, genuineness of the information displayed on the portal/ app and take adequate precautions on their own before finalizing the alliance.
G. The members availing online chat facility shall not misuse or misbehave with other members.
H. The members or non-members seeking alliance with members of EPP are advised to make independent verification of all credentials of the members, including verification of medical history and other antecedents. UEPL shall not be responsible or liable for any misrepresentation or falsity of information on the portal / app.
I. Members shall be personally responsible and liable for their online/offline conduct, behaviour, language used and information transferred on ‘online chat’. Any incident of rash negligent/indecent behaviour by a member entails penal consequences apart from cancellation of membership and deactivation of all services.
J. Member intention should be only to enter into a matrimonial alliance.
12. ERRORS AND DISCREPANCIES:
A. While UEPL takes every care and caution to maintain the site free of errors and discrepancies, it is possible for some mistakes to creep into the portal / app by inadvertence, oversight, human error, innocence and honest belief in the information in good faith. UEPL shall not be liable in respect of innocent dissemination of such information and the liability of UEPL is limited to removal of such errors and discrepancies from the portal / app. Members and visitors may bring any such discrepancies to the notice of UEPL with reasonable proof for necessary action.
B. Members must fairly disclose their current marital status, sexual orientation and about children through earlier marriage, if any, and such information is published in the portal in good faith. UEPL does not undertake any verification and therefore does not vouch the correctness of such information.
14. Copying, storage, transmission, circulation of any information including photographs, profiles, code numbers, membership numbers, addresses, etc displayed on the site, is strictly prohibited. Any unauthorized distribution of such material entails penal action.
15. The members/visitors shall be solely responsible and liable for all the consequences arising out of any infringement of copyrights, proprietary rights , privacy rights including but not limited to damages, attorney fees and expenses.
16. UEPL shall not undertake any responsibility for display of any erroneous or unauthorized material or information on the portal / app and the liability of UEPL in case of any such display shall be limited to the removal of such information or material from the portal / app and providing the details of the membership account from where the offending information or material is found to have been uploaded to the portal / app as per the records of UEPL.
17. The membership/access to the portal / app is available subject to the condition that the portal / app is accessed/used at the sole risk of the member/visitor. UEPL cannot and does not guarantee about the availability of connection to the site, the services, and facilities nor does it assure any accuracy, quality,quantity,genuineness and promptness of any of the services offered on the site.
18. While every endeavor is made to make the portal / app free of any bugs, errors, viruses, failures, delay in transmission etc. UEPL does not guarantee that the portal / app or any of the services offered would be free of bugs, errors, viruses, failures and UEPL does not accept any responsibility or liability for any such bugs, errors, viruses, failures delay in transmission etc in the site.
19. UEPL reserves the right to make such additions, alterations, modifications, insertions, improvements to the site for the betterment and quality enhancement of the material displayed on the site. The members shall also agree for such modifications to the material for compatibility with the technological advancement and shall, without demur, agree for any changes that may be required to be made at the discretion of UEPL and also provide such information or material that may required for updation or upgradation of the site in view of any technological advancement.
20. INDEMNITY:
A. The members shall indemnify UEPL against any claims by third parties against UEPL in respect of any material posted by them on the site or any claim made by them in the profile.
B. The members shall indemnify UEPL against any claims by third parties in respect of infringements of any Intellectual Property Rights in respect of and in relation to any material posted by them on the site.
A. UEPL has a valid contract with a Data Processing entity to process the Digital personal data of members.
B. The Data Processing entity hired by UEPL has a professional and highly qualified personnel process the Digital personal data of members.
C. UEPL has systems in place to implement appropriate technical and organizational measures to comply with the provisions of DPDP Act 2023.
D. UEPL is taking all reasonable security safeguards for the protection of the Digital Personal Data of the members.
